Stake Brazil is unavailable again after a federal appeals court suspended the temporary injunction that had allowed the operator to remain online until October 25, 2026. The change took effect after the TRF-3 ruling on October 9, with Stake’s Brazilian site and app unavailable again from October 10.

What Changed in the Stake Brazil Case?
Brazil’s Medida Provisória No. 1,394/2026 introduced a nationwide prohibition on the exploitation, offering, intermediation and advertising of fixed-odds betting. The rules began affecting access to licensed platforms in early October.
On October 8, a federal court in São Paulo granted Stake Brasil limited temporary protection. That order allowed the operator to remain available until October 25 while the wider legal dispute continued.
The next day, the president of the TRF-3 suspended that injunction following an appeal by the federal government. The suspension removed Stake’s temporary exception, allowing the authorities to resume the restrictions and blocking measures that apply under the provisional measure.
This does not settle the constitutional challenges to the betting prohibition. It suspends the temporary relief granted to Stake while the underlying litigation continues.
Is Stake Available in Brazil?
No. Stake’s Brazilian site and app have been unavailable again since October 10, 2026. The operator’s Brazilian service notice says activities are suspended in compliance with the current legal position.
Players should not try to bypass the restriction or use unofficial domains. The only official Brazilian domain identified by the operator is stake.bet.br, which currently displays the suspension and refund information.
What Happens to Open Bets?
The current process separates bets by their status:
- Bets with a result determined by October 9 were settled normally, with winnings added to the player’s balance.
- Bets that were still open were cancelled, and the full stake was returned to the player’s balance.
- The refund amount can include the available balance recorded on October 10, returned stakes from cancelled bets, winnings from bets settled by October 9 and bonuses already converted into real-money balance.
How Are Account Balances Returned?
Players do not need to submit a withdrawal request for the automatic return process. Stake Brasil is sending each player’s balance information to the payment institution connected to the account.
The payment institution must transfer the money to a bank account held under the same CPF. The preferred destination is the bank account previously used to fund the betting account. Once the institution receives the player list and amounts, the legal process allows up to seven days for the transfer.
If the original bank account is closed or unavailable, the money may be sent to another account under the same CPF. If no suitable account is available, the funds may be routed to Caixa Econômica Federal for return under the supervision of the Ministry of Finance.
What Does the Court Decision Mean?
The October 9 decision changes Stake’s immediate operating position, but it is not a final judgment on the validity of the provisional measure. Broader challenges remain before Brazil’s courts, and the measure is also subject to the country’s legislative process.
The Brazilian Ministry of Finance’s overview of MP 1,394/2026 explains the national rules now governing fixed-odds betting. Because the legal position can change, players should rely on current official notices for account-specific instructions.
Stay Alert for Refund Scams
Refunds should not require a new deposit, a fee, a password or a verification code sent to another person. Messages asking for any of these should be treated as suspicious.
Use only the official support channels displayed on the operator’s Brazilian suspension page, keep any support protocol number, and verify that any receiving bank account is registered under the same CPF.
The Bottom Line
Stake’s short-lived injunction no longer protects its Brazilian operations. The site and app are offline again, open bets have been cancelled and balances are being returned through the prescribed payment process.
The litigation is still active, so this is the current position rather than a final resolution of every legal challenge. Players should follow official updates and avoid any attempt to access unverified sites or intermediaries.
